This site is owned by Luisa Convers (hereafter referred to as Y_You -The Wellbeing Hub – Merchant), registered in Belgium, and email address at info@luisaconvers.com.

Any membership purchase or furnishing of personal details for free limited use of the website signifies that the customer has reviewed and has agreed to these Terms and Conditions for use of the site, our posted videos and referrals to 3rd parties, and any information and advice contained therein. The click validating the membership purchase implies full acceptance of these terms and represents the customer’s “digital signature”.

Purpose

These Terms and Conditions set out the rights and obligations for both The Wellbeing Hub and its members.

Order Confirmation

All membership purchases will be confirmed by email to the address specified by the customer during the purchase of their chosen package. The Merchant is not responsible for technical confirmation delays.

Proof of Transaction

Information and data held by Y_YOU are collected and maintained in reasonably safe circumstances and stored as proof of purchase and understanding of our Terms and Conditions. Specific payment information is held by the credit card merchants we use to process payments. They are responsible for the data you furnish to conduct purchases and we hold no information procured by them. We will make reasonable efforts to safeguard the data we collect and maintain, but hold no responsibility for this information, except in cases of negligence in accordance with normal business practice.

Our Videos, Blogs and General Information and Advice

Videos

If you are new to exercise or have been diagnosed with a long-term health condition, are pregnant, or have any musculoskeletal issues, please consult your medical doctor, or other qualified practitioners before using the videos on our site.

These videos are for home use only and membership does not grant permission to duplicate or download from our platform. The use of any material without the written permission of Luisa Convers may be a breach of contract and violation of the copyright of the video productions and teachers featured.

This applies to photos, images, and all of the design elements within the videos as well as our website, Youtube channels, and other social media.

Blogs, General Information, and Advice

Every effort has been made to ensure the accuracy of information and advice featured within our platforms, our blogs, lifestyle and yoga information, and advice. Luisa Convers, The Wellbeing Hub, and our contributors shall not be held liable for the consequences, accidents, or damages resulting from the advice contained within this website, our social media accounts, or posts from 3rd party sources. This is in force even in cases where The Merchant was aware of the possibility of such damages. General comments and complaints should be addressed to Luisa Convers at info@luisaconvers.com.

Validity Period of Offer and Prices

Membership and prices for merchandise are valid at the time of purchase and are subject to change at any time unless agreed through the purchase.

Video Quality and Issues with Use

We are not responsible for viewing issues resulting from faulty internet connections, low bandwidth, or lack of cellular data reception. Our videos are placed online and by agreeing to these Terms and Conditions, you acknowledge that you understand that access to the internet is required to view them.

Issues with the quality of the videos should be addressed in writing to Luisa Convers at info@luisaconvers.com.

Cancellation of Memberships

You can sign up for a 7-day free trial and cancel any time during your free access. Once your free access expires, subscriptions are non-refundable. You can cancel your subscription at any time and you will not be charged further. You will still have access to the videos until the period you have paid for expires. If you are on a yearly subscription you may cancel at any time but will not be refunded for the remaining period of your subscription.

Use of Trademarked Images and Logos

The unauthorized use of any trademarks, logos, or brands present on the site is strictly forbidden. These include but are not limited to the Wellbeing Hub, Luisa Convers, and Y_You.

Force Majeure

Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties’ control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission, or accident beyond the control of either party, despite all reasonable efforts to the contrary. In addition to events usually recognized by the Belgian courts, a force majeure event includes in particular (without limitation) the following: industrial action, natural or manmade disasters, and the impossibility of the use of public or private telecommunications networks.

In such circumstances, the party delayed or unable to perform shall notify the other party within ten business days following the date such events become known.

Unless prevented due to force majeure, both parties will correspond within three months to examine the impact of the event and agree to the conditions under which the contract shall be continued. If the force majeure lasts longer than one month, this agreement may be terminated by the injured party.

Partial Invalidity

These Terms and Conditions remain valid and in force, even if one or more clauses are invalid or declared so under any law, regulation or following the final decision of a competent court.

Non-Waiver

No failure of either party to exercise any power given to it in these Terms and Conditions or to insist upon strict compliance by the other party with its obligations hereunder shall constitute a waiver of either party’s right to demand full compliance with the terms hereof.

Data Protection

All personal data you provide to us will be treated in accordance with the data protection principles.

Applicable Law and Competent Jurisdiction

In form and content, these Terms and Conditions shall be governed by and construed in accordance with Belgian law. All orders placed on The Merchant’s site strictly imply acceptance of The Merchant’s Terms and Conditions.

In case of dispute or claim, the customer agrees to seek an amicable solution with The Merchant before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the Belgian courts.

Changes to these Terms and Conditions

Any changes to these Terms and Conditions will enter into force after giving written notice to the existing members of the WellbeingHub, or as clearly identified on our website.
